DMCA Policy

1. Overview
hintsylee (“we”, “us”, “our”) respects the intellectual property rights of others and expects our customers and visitors to do the same. This Digital Millennium Copyright Act (“DMCA”) Policy explains how copyright owners can notify us of alleged infringements related to content displayed on or linked from our website (the “Site”).
This Policy is intended to comply with the DMCA (17 U.S.C. § 512) and applies to content that we control on the Site. Nothing in this Policy is legal advice. If you have questions about your rights, you should consult a lawyer.

3. How to Submit a DMCA Takedown Notice
To be effective under the DMCA (17 U.S.C. § 512(c)(3)), your takedown notice must include all of the following information:

Your physical or electronic signature.
This can be your full legal name typed at the bottom of your email or letter. -
Identification of the copyrighted work that you claim has been infringed.
If multiple works are covered by a single notice, you may provide a representative list. -
Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on the Site (such as specific URLs, product pages, or screenshots).

Your contact information so that we can reach you, including at least your full name, mailing address, telephone number, and email address.

The following statement (or equivalent wording):
“I have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”

The following statement (or equivalent wording):
“The information in this notification is accurate, and under penalty of perjury, I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
If your notice does not include all of the required information, we may be unable to process it. We may also share your notice with the user who uploaded or posted the material in question, or with third parties as required by law.
4. Our Response to Valid Notices
If we receive a valid DMCA notice, we will:

Review the notice for completeness and legal sufficiency.

Remove or disable access to the allegedly infringing material, where appropriate.

Make a good-faith attempt to notify the user or customer who uploaded or provided the material, including a copy of the notice or a summary of its contents.
We may, in our discretion, request additional information from you if clarification is needed.
5. Counter-Notification
If your content has been removed or disabled as a result of a DMCA takedown notice and you believe this is a mistake or that you have the right to use the material, you may send us a counter-notification.
To be effective under the DMCA (17 U.S.C. § 512(g)(3)), your counter-notification must include:

Your physical or electronic signature.

Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled (for example, the exact URL on our Site).

A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.

Your name, mailing address, telephone number, and email address.

The following statement (you may adapt as needed to your location):
“I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside of the United States, I consent to the jurisdiction of any Federal District Court in which hintsylee may be found, and I will accept service of process from the person who provided the original notification or their agent.”
Send your counter-notification to our designated copyright agent at support@hintsylee.com with the subject line “DMCA Counter-Notification”.
Upon receipt of a valid counter-notification, we may restore the removed material within 10–14 business days, unless our copyright agent receives notice that the original complainant has filed a court action seeking to restrain you from engaging in the allegedly infringing activity.
6. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, hintsylee may terminate, in appropriate circumstances and at our sole discretion, accounts or customer relationships of users who are deemed to be repeat infringers.
We may also limit access to the Site, disable the ability to upload or submit content, or cancel orders that we reasonably believe may infringe the rights of others, whether or not a formal DMCA notice has been filed.
7. Misrepresentations
Under the DMCA, any person who knowingly misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages (including costs and attorneys’ fees) incurred by the alleged infringer, the copyright owner, or service providers.
Please be sure that you have a genuine, good-faith belief in your claim before submitting a DMCA notice or counter-notification.
8. Changes to This DMCA Policy
We may update this DMCA Policy from time to time to reflect changes in the law or our practices. Any changes will be posted on this page with an updated effective date. Your continued use of the Site after such changes constitutes your acceptance of the revised Policy.
